By accessing or using Pearch, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Pearch reserves the right to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Last updated" date. Your continued use of Pearch after any changes constitutes acceptance of those changes.

Pearch is intended for users who are at least 18 years of age or the age of legal majority in their jurisdiction. By using Pearch, you represent and warrant that you meet these eligibility requirements and that you are not prohibited from using the service under applicable law.

To access certain features of Pearch, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

You agree not to share your account credentials or give others access to your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You agree not to use Pearch for any purpose that is unlawful or prohibited by these Terms. You may not use Pearch in any manner that could damage, disable, overburden, or impair the service, or interfere with any other party's use of Pearch.

You agree not to attempt to access any part of Pearch that you are not authorized to access, and not to engage in any activity that interferes with or disrupts Pearch or the servers and networks connected to Pearch.

The Pearch service and its original content, features, and functionality are and will remain the exclusive property of Pearch and its licensors. The service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pearch.

We may terminate or suspend your account and bar access to Pearch immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using Pearch, or delete your account through your account settings. All provisions of the Terms which by their nature should survive termination shall survive termination.

Pearch is provided on an "AS IS" and "AS AVAILABLE" basis. Pearch and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither Pearch nor its suppliers and licensors, makes any warranty that the service will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, Pearch at your own discretion and risk.

In no event will Pearch, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; or (iii) for interruption of use or loss or corruption of data.

Pearch shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
